It has been confirmed that HYBE and ADOR are "not guilty" of alleged "workplace bullying."
According to industry insiders on the 24th, the Seoul Regional Employment and Labor Office under the Ministry of Employment and Labor recently concluded an investigation into a complaint filed by former ADOR employee A against CEO Kim, finding "no evidence of suspicion" and processing the complaint as "an administration closure (not guilty)." The gist of the argument is that its impossible to confirm workplace bullying based solely on the documents submitted by the complainant.
Last December, through media interviews, A claimed that ADOR lured her for a "business discussion" but illegally confined her for about 3 hours and demanded her personal cell phone, which resulted in workplace bullying. She reported CEO Kim to the Ministry of Employment and Labor regarding the matter.
Prior to this, New Jeans members also revealed in a statement, "We witnessed managers and performance directors (Purdy) who were helping with schedules being severely bullied by ADOR and HYBE, having their laptops taken away and being questioned without notice, making them cry. 'We cannot accept this kind of behavior towards staff members who are working on their remaining schedules.'"
In response, ADOR stated at the time, "An employee in charge of the artists' management (referring to A) directly contacted the advertiser and encouraged the artist and the brand to sign a direct contract excluding the company. The manager himself admits to this communication. This is a serious act of misconduct that helped the artist violate their exclusive contract."
"In the process, the employee in question was inevitably placed on standby and the return of the laptop, which is company property, was demanded. During the process, there was no illegal confinement or any other coercive behavior. The company has requested an interview several times to give the manager a chance to explain himself, but the employee in question has refused all of them."
Some say that the Ministry of Employment and Labor's latest investigation results support ADOR's claim that "there was no coercive behavior." All three claims of "workplace bullying" found 'not guilty.'
This isn't the only case where ADOR has clashed with former Vice President L through a petition to the Ministry of Employment and Labor. Former VP L, whom HYBE regards as an accomplice of former ADOR CEO Min Hee-jin, also reported that "she was bullied in the workplace by HYBE's management," but the case was administratively closed.
In September of last year, former VP L reported 5 HYBE executives for workplace bullying, claiming that "HYBE had conducted an illegal audit, including forcibly collecting information assets." Regarding this case as well, authorities closed investigated claims of both and concluded that "there were no charges."
It's interpreted that former VP L filed this case under the instructions of former CEO Min Hee-jin in order to obstruct HYBE's re-investigation in relation to the sexual harassment and bullying petition by former ADOR employee B against former VP L.
A petition filed by self-proclaimed New Jeans fan through the National Petition for an investigation into Hanni's workplace bullying has also been closed. The authorities found it difficult to judge Hanni as a worker under the Labor Standards Act. The reason was that, due to the nature of management, it was difficult to see any direction or supervision from the company, as they were merely contractually equal parties performing their respective contractual obligations.
