Yang Hyun Suk has denied allegations that he threatened Han Seo-hee over iKON B.I's drug case.
On the 12th, the 1st appeals trial of Yang Hyun-suk's "retaliation threat" charges was held at the Seoul High Court Criminal Division '6-3 with presiding judges Lee Eui-young, Won Jong-chan, and Park Won-cheol. At the hearing, Yang Hyun Suk introduced himself as YG Entertainment's "Executive Producer."
The prosecution stated, "The lower court found the defendant not guilty but the defendant met the victim at the YG office building and used words and actions to persuade and pressure whistleblower A (Han Seo-hee) to reverse her statements in the criminal case again former iKON's B.I (Kim Hanbin). While against social justice, it's not a crime under the law therefore no legal responsibilities can be brought forth. However, a charge of coercing and aiding and abetting is added to those who force or use force to coerce whistleblowers without justifiable grounds and is punishable with imprisonment for up to 3 years or a fine of up to 3 million won."
Yang Hyun Suk retorted, "A received a call from Han Seo-hee and told me so I asked for a meet up and we met on the 7th floor of YG and talked for 20 minutes. I first met Han Seo-hee in the past at an entertainment establishment so we were comfortable with each other. I thought of her as a close acquaintance and asked to meet comfortably. It wasn't under any threatening manner."
While Yang Hyun-suk was acquitted in the first trial, the prosecution that filed the appeal stated, "We're appealing because there was a misunderstanding of the facts and law in the original trial. We're requesting a change of indictment for forced interview under Article 5, Paragraph 4 in the violation of the Act on Aggravated Punishment for Specific Crimes. The victim (Han Seo-hee) insisted from the beginning of the investigation in their court testimony that Yang Hyun Suk threatened harm to the effect of "he would k*ll her off the entertainment industry." It's a mistake to say there was no basis in fact. Even if the defendant's direct and specific notice of harm was not proven, the trial confirmed that it was correct that the victim had felt fear in light of the circumstances including other remarks and actions. The crime of intimidation only requires the level of causing fear and does not judge whether or not that fear happened in reality."
In response, Yang Hyun Suk's lawyer stated, "There was no misrepresentation of facts or misunderstanding of the law. The original judgement was extremely justifiable so we're asking for the appeal to be dismissed."
Regarding the confrontation between the two sides, the judge stated, "There are unresolved questions in the first trial judgement. It's true that the victim's statement was overturned but I will look carefully at what caused the statement to be false and what happened that day (meet up with Yang Hyun Suk).
The judge then briefly asked Yang Hyun-suk about the situation at the time of the incident and Han Seo-hee's reaction to his words "tell the truth."
Yang Hyun-suk replied, "At the time, Han Seo-hee came from a situation where she was caught up in another drug case so she did not show a confident appearance. She didn't talk much. She never talked about getting a lawyer."
The next hearing will be held on May 24th.
